Typographical Errors
In the event that a IP Phone Warehouse product is mistakenly listed at an incorrect price, IP Phone Warehouse reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. IP Phone Warehouse reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, IP Phone Warehouse shall issue a credit to your credit card account in the amount of the incorrect price.
Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by IP Phone Warehouse without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

IP Phone Warehouse may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to IP Phone Warehouse.
Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of Wisconsin, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of IP Phone Warehouse products) shall be in the state or federal courts located in Milwaukee County, Wisconsin. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of IP Phone Warehouse products) must be commenced within one (1) year after the claim or cause of action arises. IP Phone Warehouse's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. IP Phone Warehouse may assign its rights and duties under this Agreement to any party at any time without notice to you.
Taxes
Customer shall be responsible for any state or local tax (excluding taxes based on IP Phone Warehouse's income or profits) that results from the transfer of title or sale or delivery of the Products purchased hereunder unless a valid and correct tax exemption certificate is furnished to IP Phone Warehouse prior to delivery.
Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a IP Phone Warehouse or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.
Participation Disclaimer
IP Phone Warehouse does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, IP Phone Warehouse is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, IP Phone Warehouse reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable to IP Phone Warehouse in its sole discretion.
Indemnification
You agree to indemnify, defend, and hold harmless IP Phone Warehouse, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.
Third-Party Links
In an attempt to provide increased value to our visitors, IP Phone Warehouse may link to sites operated by third parties. However, even if the third party is affiliated with IP Phone Warehouse, IP Phone Warehouse has no control over these linked sites, all of which have separate privacy and data collection practices, independent of IP Phone Warehouse. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, IP Phone Warehouse seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).
Return Policy
Some items are returnable through IP Phone Warehouse and some items are not. The following brands are not returnable to IP Phone Warehouse due to the manufacturer�s policies and restrictions: Epygi, Quintum, GN Netcom, Plantronics, and UT Starcom. Other manufacturers not listed may also have similar policies. In the event that a defective item is received from one of the above manufacturers, please contact the manufacturer directly. Please contact the manufacturer for warranty information, as well. Please contact IP Phone Warehouse if you would like information about warranties and return information before purchasing your merchandise.
Other items come with a Money Back Guarantee. In the event that one of these items is returned, IP Phone Warehouse is not responsible for this return. Users should contact the manufacturer directly in these circumstances.
Unless IP Phone Warehouse is contracted for installation or support services, IP Phone Warehouse will not assist in the installation or configuration of products under any circumstances. IP Phone Warehouse may provide firmware/software updates and manuals subject to availability.
Note: Absolutely no software or license keys are returnable.
To return an item that is returnable, please contact a IP Phone Warehouse customer service representative either via email (service@ipphone-warehouse.com) or phone (888) 201-9056 during regular business hours (8 am to 5 pm CST) before shipping product back to IP Phone Warehouse. This will help to expedite and ensure the proper action or credit upon processing. You will be issued an RMA (Return Merchandise Authorization) code that will be used for your return. For further expedition, when requesting your RMA, please have the following information handy:
- Customer Number
- Invoice Number
- Serial Number
- Reason for Return
- Action Requested (Replacement/Return/Repair/Credit)
- Whether or not the box has been opened or if it is still factory sealed
In order to receive full credit for merchandise, all returns must be received in original condition and packed in the carton as if from the Manufacturer (this includes all foam padding or bubble wrap, all manuals, blank warranty cards, accessories, and/or other documentation included with the original shipment. RMA approval is contingent upon receipt of 100% complete products, among other things.
Customer is responsible for shipping charges to IP Phone Warehouse. Products can be returned if in applicable amount of time after purchase. After this time, product is considered �acceptable� by customer and cannot be returned.
NOTE: Software cannot be returned under any circumstances.
Customer is responsible for all risk of loss or damage incurred during shipping. For this reason, IP Phone Warehouse strongly recommends using only insured parcel post for delivery.
Note: any non-defective item that is returned (wrong item, for example) has a minimum of a 15% restocking fee. This fee will not exceed 30%. The percentage is calculated using your order plus any handling fees.
Refurbished items are not returnable unless proven defective. If found defective refurbished items can only be exchanged for the same item.
Customer is responsible for shipping all returned items back to IP Phone Warehouse.
